General terms and conditions of business

1. Scope

All services provided to the customer by the online shop www.online-moebelshop.ch are carried out exclusively on the basis of the following general terms and conditions.

2. Offer and conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to the customer to place a binding order.

By clicking the order button, the customer places a binding order for the goods listed on the order page. Immediately after receiving the order, the online shop confirms receipt of the order by email. A contract is not concluded through confirmation of receipt. The purchase contract is only concluded upon delivery of the goods.

The online shop operator is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims due to delay in delivery or failure of delivery are excluded.

3. Payment options

The prices stated on the item page include statutory VAT and other price components and are in Swiss francs (CHF) unless otherwise stated.

The payment options offered as payment methods in the online shop under “Payment method” are available to the customer. If you pay with a credit card or other instant payment method, you will be charged when you order. If you pay in advance, delivery will only take place after payment has been received. Payments must be made in Swiss francs unless otherwise stated.

4. Delivery and shipping

All items are delivered according to the shipping conditions listed in the shop. The customer will be informed of a provisional delivery date on the item page or in the shopping cart of the online shop or the customer will be contacted and an individual delivery date will be agreed. If an item is not available at short notice, the shop operator will inform the customer about the expected delivery time, provided the correct address is available.

The shipping conditions generally only apply within Switzerland and the Principality of Lichtenstein. For deliveries abroad, the customer assumes the applicable taxes and customs duties as well as the parcel fees and any other administrative expenses. The shop operator can exclude the invoice payment method for orders from abroad.

5. Return Policy

Orders oblige the customer to accept the items and/or services. The shop operator may accept subsequent changes or cancellations of the customer's orders at its own discretion and charge a compensation fee.

6. Retention of title

The delivered goods remain the property of the online shop operator until the purchase price has been paid in full.

7. Late Payment

If payment is not made within the due date, the customer will be in default. In this case, the shop operator reserves the right to charge the customer a reminder fee in addition to the invoice amount. In addition to paying the invoice amount, the customer is also obliged to reimburse all costs incurred as a result of late payment.

8. Warranty

The shop operator guarantees that defects will be corrected. This is done at your choice through subsequent performance, namely elimination of a defect (repair) or delivery of a defect-free item (replacement delivery). If subsequent fulfillment fails, the customer is entitled to withdraw from the contract. This does not apply to insignificant defects. The customer's right to a reduction is excluded.

9. Disclaimer

The shop operator excludes liability for slightly negligent breaches of contract.

10. Data Protection

The data transmitted by the customer is used exclusively to process the orders. All data will be treated confidentially. The data will only be passed on to third parties (e.g. shipping services) if this is necessary for order processing. The order data is transmitted encrypted and secured, but the shop operator assumes no liability for data security during these transmissions over the Internet (e.g. due to technical errors by the provider) or for possible criminal access by third parties to files on the Internet presence.

11. Final provisions

If a provision of these general terms and conditions is ineffective, the rest of the contract remains valid. The relevant statutory provisions apply in place of the invalid provision.
